YOUR CONTRACT WITH US

  Our acceptance of your deposit forms a contract between "Costa del Sol Holidays" and the party leader acting on behalf of all 
 members of the party.

  The signature on the booking form is deemed as acceptance of our terms and conditions on behalf of the party.  In the absence
  of a signature, the payment of the deposit will be regarded as an automatic acceptance of our conditions.

  No other conditions will apply to the contract unless confirmed by us to you in writing.

  The holiday and services confirmed to you by either ourselves or one of our agents are provided directly by Costa del Sol
  Holidays. Your  party is contractually bound by these terms and conditions

   PRICES
 
The prices quoted are for self catering holidays in privately owned properties in beachside resorts which are subject to 7%
   I.V.A. (spanish V.A.T.) but inclusive of water, electricity, change of bed linen/ towels every 7 days and standard clean after
   your departure
.


   DEPOSITS
   RETURNABLE DEPOSIT:  A returnable security deposit of 200 € will be included in the final invoice. Payment will be "held"
   against credit card details.  Any breakages and damages to the property will be deducted from this deposit.

   Credit Card Details:  Please note that credit card details will be required at time of reservation to be "held" as security
   against any loss, damage or any additional services ordered.  If these costs exceed the returnable deposit amount of € 200, 
   these additional costs will only be charged to the credit card if the final statement of account has not been settled before the
   client´s departure.

   I.V.A. (Spanish Tax)
  All prices will be subjuect to 7% I.V.A.

   BOOKING CONDITIONS 
   1.  All Reservations must be confirmed in writing either by post, fax or e-mail.
   2. A deposit of 50% of the invoice will be required to secure your reservation with the balance to be paid by at least 42 days
       before arrival date. 
   3. If we do not receive written notice of cancellation within 14 days of receipt of our booking confirmation you will be deemed
       to have fully and irrevocably accepted our terms of business.
   4. In the case of late reservations, payment of the holiday must be paid in full at the time of reservation. 
   5. Availability of facilities, entertainment and attractions will vary with the time of the year. We will be pleased to provide
       information on request.
   6. The property details may vary slightly due to the fact that not all properties on the same resort are identical, therefore, the
       décor or furnishings may differ as each property is privately owned.
 

   CHANGES TO YOUR HOLIDAY
 
  1.  It is unlikely that we will have to make changes to your holiday but arrangements are made many weeks/ months in
        advance.  Sometimes it may be necessary to make changes, and we reserve the right to do so at any time.

   2.  In the event of a client's booking being transferred to another property, due to circumstances beyond our control, we will
        endeavour to ensure that the replacement property will be of equal value or upgraded standard.

   METHODS OF PAYMENT
  
Payments may be paid by any one of the following:

   1. Euro/ Sterling bankers draft.
   2. Sterling cheque - a fixed rate of exchange will need to be
       requested at time of reservation. 
   3. Bank transfer as detailed in invoice provided.
   4. Credit card payments as detailed in invoice provided.
       (will be subject to 3% charge).
   PAYMENT CONDITIONS
 
1. Please do not send cash payments through the post. 
  2. Payments by personal cheque cannot be accepted within
      28 days of the start of your holiday.
  3. All payments should be made by one person, and when-
      ever possible, this should be the person named on the
      confirmation invoice.
  4. Refunds: Any refunds will be paid by cheque or bank
      transfer to the person named on the confirmation invoice. 

   CANCELLATIONS
 
You may cancel your booking, or part of it, but the instructions will only be valid if in writing and signed by the party leader
   who signed the booking form.  To compensate us for the expense of processing your booking and for the risk that we may
   not be able to re-sell the holiday, we charge a cancellation fee on the scale shown below:-


      1. More than 56 days notice given - loss of 50% of deposit paid
      2. between 56 - 14 days notice given - loss of total deposit
      3. 13 days or less notice given - loss of total payment.

 
We strongly advise that clients take advantage of cancellation insurance.


  LOSS, DAMAGES & ACCIDENTS
 
1. Persons renting within a private community must note that Costa del Sol Holidays, the Owner of the property nor the
      Community have any liability for any loss, damages or accidents incurred by clients, members of their family or any other
      persons visiting or residing with them.
  2. You should ensure that you have your own insurance to cover such eventualities.
  3. Visitors will be held responsible for any breakages or damage to the property by members of their family and visiting
      friends. The property inventory will be checked over on a weekly basis, therefore, any damages will be deducted from the
      returnable deposit.

  CALL-OUT CHARGES
 
An emergency number will be provided in the "Welcome Envelope" on arrival.  This is only in the case of extreme urgency.
  A fee of 50 € will be automatically charged to the client in the case of non-essential call-outs or if the client is held accountable
  for any of our staff called out of office hours.

  COMPLAINTS
 
If you have any complaints about your holiday, please inform one of our on-site offices immediately.  Most matters can be
  easily resolved while you are in the resort and a member of our staff can see and understand the exact nature of any problems
  that you may have.

  GENERAL BEHAVIOUR
 
1.  All clients are governed by the "General Resort Rules & Regulations" that will be attached to the booking form and rental
       information pack.

  2.  We reserve the right to decline to accept or retain any person as a client if their conduct is disruptive or affecting the
       enjoyment of other holidaymakers.  The rental contract will be deemed as terminated and cancellation charges will apply.
